Contract of sale
1. Any order placed by you in the manner described in this site is an offer by you to purchase a particular product for the price (including the delivery and other charges) specified on this site at the time you place your order. When you have completed your order you will be sent an e-mail confirming your order. It will state what the products are, the cost and delivery and invoice details. This order receipt will not be a binding acceptance of the order. The order receipt can be combined with the acceptance.
2.We are authorized to accept the order within three workdays after we have received your order. We are authorized to reserve the right of withdrawal from the contract of sale - perhabs after checking the creditworthiness of the customer. We are authorized to limit the order to family quantities.
3.We are authorized to partial shipment. Of course we accept the costs of partial shipment.
4. Normally all of our offered products are on stock. However it can come to a delivery bottleneck because of the rare raw materials and/or long route of transportation.
With your online order you submit, Essenza Nobile GmbH reserves the right of acceptance of the order or withdrawal from the contract of sale. The information we give on goods and prices within the ordering process is subject to alteration and not binding.
Reservation of Proprietary Rights
1.Until complete payment of all invoices the products shall remain the property of Essenza Nobile GmbH.
2.The customer is committed to treat the goods carefully.
3. Should the buyer get into delay of payment or fails to fulfil any other fundamental contractual obligations according to point 2 and 3, Essenza Nobile GmbH can withdraw from the contract and reclaim the goods.
Right of withdrawal
1.In accordance with §355 of the "Bürgerliches Gesetzbuch (BGB)" (German Civil Code) you have the right to withdraw from the contract of sale.
You can cancel, in writing (eg, letter, fax, e-mail), your declaration of contract within two weeks without giving any reasons or by returning the goods. The period begins with the date of receipt of the goods and these written instructions. The rescission period is sufficient to send the revocation or the goods. The withdrawal should be sent to:

Please give notice of your returns. Please affix sufficient postage. Above a goods value of 40-€ the cost of shipping will be reimbursed.
The made to order articles, including the bottling, which we provide for you from our range of products, can not be returned.
Revocation consequences:
In the case of an effective revocation, the benefits received by each party and any continued benefit (such as interest) shall be reimbursed. If the service received cannot or only partially or in a deteriorated condition be returned, you are obliged to pay compensation for the value thereof. This does not apply if by the surrender of goods, a deterioration of the goods upon examination – as would be possible in the shop- can be ascribed.
In addition, the payment of compensation can be avoided by not using the goods as personal property and refraining from any actions that could affect their value. Packageable goods are to be returned.
You shall pay the cost of return shipping if the value of the delivered goods are of an amount not exceeding 40,00 € or when goods above the value of 40,00 € have been ordered and no full or contractual partial payment has been made at the time of revocation.
Otherwise, the shipping cost will be reimbursed. We are responsible for the risk of return. Non packageable items will be collected by us. Your obligation to refund payments must be fulfilled within 30 days after sending your cancellation.
The right does not apply for the supply of audio or video recordings or software, if the data supplied medium has been unsealed.
End of the revocation notice
Payment
1.The offered price is authoritative and becomes due at the delivery date. The price contains the sales tax.
2. The delivery rates are 3,90 Euro up to a merchandise value of 50,-Euro, for shipment within Germany. If the value of goods is over 50 € we pay the delivery within Germany. We are shipping the goods accordingly insured.
3. Once you've decided what you want to buy, you can choose from the following payment options--and rest assured that your details are safe with us. You can pay per credit card or prepayment. We recommend payment per credit card. If you choose to pay per prepayment you have to consider that you will have to pay besides the invoice amount, also the bank charges.
4. In the event that the customer is in default of payment, Essenza Nobile GmbH shall be entitled to charge default interest of 5% above the current basic interest rate of the European Central Bank.
Data protection
1.The data required for order processing is stored. All personal data is treated confidentially.
2.The customer accepts the collection, reduction and use of individual-related data.
Final Provisions
1.The headquarters of the company are in Germany. German law applies to the exclusion of the UN Sales Convention. The place of jurisdiction is Hamburg.
